Amitesh Banerjee, learned senior standing counsel has produced the case diary pursuant to the order dated 07.11.2024. Report reflects that charge sheet has been submitted on or about 08.09.2024 in connection with Rabindranagar PS Case No. 397/24 dated 20.08.2024 under the relevant provisions of BNS.

In view of the investigation having been concluded and presently the petitioner apprehends that there may be violation in respect of injury to the property of the petitioner as well as his reputation and bodily injury.

I direct if complaints are pending or has been submitted with the Inspector-in-Charge, Rabindranagar Police Station the said officer would

act in terms of the Witness Protection Scheme, 2018 as under section 398 of the BNSS, the State Government is yet to constitute a particular scheme for protection of the witnesses.

Reports be submitted once in a fortnight to the jurisdictional court in seisin of the matter in respect of the steps taken for protection of the witnesses.

It is further directed that it would be the duty of the police officer also to see that the civil court's order is respected and obeyed and no untoward incident crops up because of the inimical relationship between the petitioners and the private respondents. With the aforesaid observations WPA 25060 of 2024 is disposed of.

Case diary be returned to the learned advocate appearing for the state.

A copy of the report earlier submitted before this court be handed over to the learned advocate appearing for the petitioner.
