Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. None appears for the private respondent despite service.

The petitioner is the wife of the private respondent and alleges that she was brutally tortured and assaulted and was driven out of her matrimonial home by the private respondent for which she lodged a complaint before the police authority. She has also sought return of her stridhan articles and other belongings which are lying in her matrimonial home.

It appears from the report submitted by the State that after filing the writ petition, FIR has been registered and investigation is in progress. The investigating authority is directed to conduct a fair, proper, unbiased and impartial investigation and take the same to its logical conclusion in accordance with law.

With regard to return of stridhan articles and other belongings, she is at liberty to approach the appropriate forum for necessary direction.

Since it is informed that both the parties reside in the same area and there is strained relationship between them, the police authority shall keep strict vigil over the area in order to ensure that no untoward incident takes place and to maintain peace and tranquility. The police authority shall render all assistance/protection to the petitioner as and when required.

With the aforesaid directions, the writ petition is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
