Mr. Krishna Pada Santra ...for the Petitioner Mr. Aranya Neagi ...for the State Affidavit-of-service filed on behalf of the petitioner is taken on record enclosing notice served upon the learned advocate representing State respondents as directed by this Court on 4th October, 2024.

Petitioner being widow of a deceased Teacher has approached this court with the present writ petition since her husband died-in-harness on 2nd September, 2020. After death of husband of the petitioner pension payment order was issued on 12th April, 2022 and terminal benefits including death gratuity was released in favour of the petitioner. Petitioner has come up with the present writ petition claiming interest on gratuity due to delayed payment.

State respondents are represented by learned advocate.

Accordingly, the Director of Pension Provident Fund and Group Insurance and the concerned Treasury Officer are directed to pay interest at the rate of 8% per

annum to the petitioner on gratuity from the date following the date of death of the husband of the petitioner till the date of release of same, within a period of eight weeks from the date of communication of this order.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
