The petitioners seek appointment of an Arbitrator in terms of the representation dated September 24, 2019.

The National Highway Authority of India (in Short "NHAI") is represented and submits that the writ petition is not maintainable and liable to be dismissed.

In view of the statutory alternative efficacious remedy available to the petitioners under the National Highways Act, 1956, the instant writ petition is not maintainable. There are no exceptional circumstances warranting or justifying interference by this Court.

In view of the above, WPA No. 24523 of 2022 stands dismissed.

Liberty is granted to the petitioners to take necessary steps in accordance with law.

However, there shall be no order as to costs.
