Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner's daughter in law had contested the last Gram Panchayat Election as an independent candidate. Certain untoward incidents preceded the said event. The local ruling political dispensation was against the petitioner. This led the local miscreants as well as the police to commit enormous torture upon the petitioner and her family members. On one occasion, the petitioner's household articles were looted away and the house severely damaged. False cases have been started against the family members of the petitioner, which therefore need to be investigated by an independent/superior Investigating Agency.

Learned senior counsel representing the State relies on the report filed earlier and submits as follows. The petitioner's son was wanted in a case of kidnapping and murder. The day the police authorities raided the house of the petitioner, the petitioner's family members and others attacked the police and

injured some of the raiding party members. A police vehicle was torched. The entire incident was videographed. Perused the video clipping produced on behalf of the State in a pen drive.

It appears that the police were prevented by the miscreants from going ahead. They were stopped and their vehicle purportedly damaged.

However, it also appears that there are cases and counter cases between the adverse private parties. In view of the same, let the police keep a sharp vigil at the locale and ensure that no breach of peace takes place. Surveillance shall include frequent visits by police personnel. The cases and counter cases registered as referred to in the writ petition shall be investigated by the Agency, however, under the supervision of an Officer of the rank of Deputy Superintendent of Police to be nominated by the Superintendent of Police, Uttar Dinajpur, Islampur Police District.

With these observations, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
