1. Affidavit-of-service filed in Court today is taken on record.

2. Though the writ petitioner would complain that despite a demolition order dated 3rd November, 2023 being passed, the municipal authorities are not acting on the basis thereof upon hearing the learned advocates representing the respective parties and noting from the submissions made by Mr. Banerjee, learned advocate for the Howrah Municipal Corporation (HMC) that though a hearing has already been conducted and an inspection has also been carried out, the final order of the HMC is yet to be passed.

3. Having regard to the peculiar facts noted hereinabove, I am of the view that since the municipality would submit

that the reasons supporting the demolition order is yet to be passed, I am of the view that the order dated 3rd November, 2023 cannot be acted upon at this stage.

4. Accordingly, the proceedings, which have already been initiated by municipality must be disposed of by passing a reasoned final order as expeditiously as possible preferably within a period of 2 weeks from the date of communication of this order.

5. The municipal authorities must ensure that no illegal construction is carried out at the premises No.124/2/2, Mahendra Bhattacharjee Road, Police StationChatterjeehat, Howrah-711104.

6. With the above observations and directions, the instant writ petition stands disposed of.
