The petitioner was working under the employment of respondent on and from July 20, 2002 and discharged his duties till his termination of service w.e.f. November 21, 2022. After more than 20 years of unblemished service he was not paid any gratuity despite claiming the same before the private respondent in the prescribed manner in Form-I. In spite of repeated requests, the respondent sat tight over the issue. The petitioner filed an application in Form-N on February 27, 2023 before the 2nd Respondent for a direction in Form-N which was registered as Case No. G-39/2023 (Anil Kumar Jha - vs- The Calcutta June Manufacturing Co. Ltd.) which is yet to be disposed of.

The cross-examination of the petitioner was completed on 22nd January 2025 and several dates were fixed for witness action of the private respondent and was adjourned on various occasions. Finally on 21st November, 2025, the date was fixed for evidence of the private respondent but the same could not be concluded and was adjourned by fixing the date of hearing on 5.1.2026.

Learned counsel for the petitioner in the instant case prays for early disposal of the case being Case No. G-39/23 pending before the Controlling Authority. The respondent no.2 being the Controlling Authority under the Payment of Gratuity Act, 1972 is directed to conclude the entire proceeding as expeditiously possible in accordance with law within two months from the date of communication of this order.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations and directions, this writ petition, WPA 24509 of 2025 stands disposed of, without any order as to costs.
