The petitioner claims to be the recorded owner of the property in question and alleges that the private respondents have been disturbing his peaceful possession therein on the basis of forged and manufactured deed allegedly executed in the name of Nabadwip Municipality.

The petitioner has lodged a complaint before the police authority and seeks police protection. The private respondents deny and dispute the allegations made by the petitioner.

It appears from the report submitted by the State that with regard to the present issue, two title suits were filed by the petitioner as well as the private respondents and both have been dismissed.

The Nabadwip Municipality has instituted a title suit subsequently, being Title Suit No. 48 of 2023 wherein

this Court is informed, an order of status quo has been granted by the learned Trial Court upon both the parties in respect of the property in question.

Since a civil dispute is pending between the parties as well as Municipality, the petitioner is at liberty to ventilate his grievance before the learned Trial Court. In the meantime, the police authority shall keep strict vigil in the area in order to avoid any untoward incident in view of the strained relationship between the parties and shall ensure maintenance of peace and tranquillity.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
