15.11.2022 sdas rejected C.R.M.(DB) No. 3971 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kulpi Police Station Case No. 256 of 2019 dated 01.09.2019 and charge-sheet submitted under Sections 363/365/468/471/372/373/364/302/201/ 120B/34 of the Indian Penal Code.

And In Re : Sunita Bhattacharjee ..... petitioner Mr. Sourav Chatterjee Mr. Joy Chakraborty Mr. Sandip Dinda ... for the petitioner Mr. Sudip Ghosh Mr. Apurba Kumar Datta ... for the State Learned Counsel appearing for the petitioner submits she is in custody for three years. It is also submitted that there is in no progress in the trial of the case.

Learned Counsel appearing for the State opposes the prayer for bail and submits trial is in progress. We have considered the materials on record. Petitioner and co-accused had murdered a lady and sold her minor child. Allegations are very grave. Trial is in progress. Vulnerable witnesses are yet to be examined. Under such circumstances, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.

Trial court is requested to expedite the trial and conclude the same at an early date preferably within one year
