Proceeding being G.R Case No. 2407 of 2009 in connection with Banarhat P.S case no 220 of 2009 under Sections 406/409 IPC pending before the Court of the learned Judicial Magistrate, 1st Court, Jalpaiguri, is quashed.

However, there shall be no order as to costs. Copy of the judgment be sent down to the trial court at once for necessary compliance.
