The matter though has been brought to the list on the prayer of the petitioner for extension of interim order but by the consent of the parties it is taken up for final disposal.

The opposite party Nos. 1-3 have been declared 16 annas owner in respect of the suit property in Title Suit no. 43 of 2005.

The petitioner has carried the said decree in appeal being Title Appeal No. 130 of 2006.

The petitioner claiming to have purchased a part of the suit property from other co-sharers of it had applied for amendment of his written statement. The learned Trial Judge by the order impugned dated July 25, 2023 has dismissed the said application.

In view of the scope of the appeal the amendment sought for is unnecessary, this Court though does not approve the reasoning of the order impugned but the conclusion being correct is not inclined to interfere with it.

C.O. 3627 of 2023 is dismissed without any order as to costs.
