Learned counsel for the petitioner submits that the petitioner is an octogenarian lady. After demise of her husband she started residing with her daughter, the private respondent herein. Since a joint bank account was opened in the names of her daughter and herself, the pensionary benefit of her husband which were deposited in the said account were collected by the private respondent. The private respondent is also in possession all the relevant documents pertaining to the service of the petitioner's husband. After sometime the private respondent deserted the petitioner and usurped the entire bank account and the petitioner was constrained to take shelter with her son where she is presently residing. The petitioner lodged several

complaints before the police authority which were not heeded to.

It appears from the report that the complaint lodged by the petitioner has been registered and investigation is in progress. The police authority is directed to conduct a fair, unbiased and impartial investigation and take the same to its logical conclusion, in accordance with law.

Since the petitioner alleges torture upon her by the private respondent and also submits that her fixed deposit certificates, term deposit certificates, MIS passbooks, postal savings passbooks and estate papers are in custody of the private respondent, the petitioner is at liberty to take necessary steps under The Maintenance and Welfare of Parents and Senior Citizens Act, 2007. With the above direction and observation the writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
