This is an application praying for an expeditious disposal of a proceeding being Misc. Case No.276 of 2024 under Sections 12, 18, 19, 20 and 22 of the PWDV Act, 2005 pending before the learned Judicial Magistrate, 1st Court, Suri, Birbhum, more particularly to decide the question of interim monetary relief at the earliest.

Learned counsel for the petitioner submits that the petitioner filed an application under the provisions of PWDV Act on 21.10.2024. It also contained a prayer for interim monetary relief. In the course of hearing, both the parties filed their affidavits of assets and liabilities. Yet, till date the proceeding could not be concluded. Even the question of interim maintenance/monetary relief could not be decided. The petitioner is without any maintenance allowance from the husband in spite of filing the application as far back as in October, 2024.

No prejudice will be caused to anyone if a direction is passed to expedite the matter.

It appears that there is a delay in deciding the issue of interim maintenance/monetary relief.

In view of the above and in the interest of justice, I request the learned Jurisdictional Court to conclude the proceeding at the earliest, more particularly to decide the question of interim monetary relief/maintenance as expeditiously as possible, preferably within a period of four months from the next date of hearing.

With these directions and observations, the revisional application is disposed of.

Urgent certified photostat copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
