For the Petitioner Mr. Swapan Banerjee Mr. Vivekananda Bose Mr. Diptendu Narayan Banerjee Ms. Debolina Ghosh .... For the State Affidavit of service filed by the petitioner is taken on record.

The petitioner intends to organise a demonstration rally on 3rd November, 2025 from 1 pm to 6 pm from Young Star More (Kakdwip) to Basanti Maidan (Kakdwip). The petitioner intimated the same to the police authority on 24th October, 2025 and 26th October, 2025. The letters were not responded to by the police authority. The petitioner undertakes to abide by all the relevant rules and regulations in conducting the rally.

Learned counsel for the State submits that no permission was sought by the petitioner from the police authority and it was only an information which was communicated to the authority. Learned counsel has submitted the terms and conditions for conducting such rally which is as follows:-

1. The number of participants should not exceed the number as fixed by the Hon'ble Court;

2. Sound system shall be used within the permissible limits as prescribed by the Hon'ble High Court, Calcutta and West Bengal Pollution Control Board;

3. Speeches capable of inciting violence, provocative speeches and abusive language will not be permitted;

4. The organisers and the volunteers shall be responsible for any violation;

The participants shall not obstruct traffic/vehicular movement and shall not cause any road blockade. It is directed that the participants will cling towards the left side of the road so that the traffic movement at any point of time is not stalled.

6. The participants in the said procession shall act in a manner to ensure that there is no damage to public property, assault on any Government Servant or any other transgression of law;

7. The participants shall abide by the instruction of the on duty police officers & shall act in a manner to ensure that no inconvenience whatsoever shall be caused to the public at large;

8. The participants at the rally should be dispersed immediately after the specified time fixed for conclusion of the said procession;

9. All other existing rules in vogue should strictly be adhered to.

Learned counsel for the petitioner agrees to the said conditions.

In view of the above, the petitioner is permitted to organise the demonstration rally as prayed for on 3rd November, 2025 from 1 pm to 6 pm from Young Star More (Kakdwip) to Basanti Maidan (Kakdwip) in terms of the conditions laid down hereinabove.

The number of participants in the rally shall not exceed 6000 at any point of time. The petitioner shall furnish the names and mobile phone numbers of organisers/volunteers before the police authority in order to deal with any situation which may arise. The petitioner may erect a stage at the terminating point of the rally upon obtaining permission from the appropriate authority. With the above observations and directions the writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
