The petitioners seek to perform Jagadhatri Puja in a private property owned by one Ramprasad Banik which is near Keshabeshwar Temple, Mandir Bazar. Permission to hold the said puja has been accorded by the owner of the land on 23rd October, 2025. The petitioners undertake to adhere to the Government regulations in playing microphone during the puja and also to ensure that the visit of the public to the temple is not hampered in any manner due to the said puja.

Learned counsel for the State raises an issue that since the proposed puja is just opposite to the temple, there may be breach of law and order if the puja is allowed to be performed at the vicinity of the temple. I have considered the submission made on behalf of the parties.

Since the petitioners intend to perform Jagadhatri Puja in a private property and have intimated the police authority regarding the same, they are permitted to do so subject to certain conditions.

The puja commences on 28th October, 2025 and continues till 31st October, 2025. The petitioners shall adhere all Government regulations in performing the puja including playing of loudspeaker and other rules laid down by the Government. In the event any dignitary visits the pandal during such period, the petitioners shall intimate the date and time of such visit before the police authority a day prior to the visit. The petitioners shall ensure that no untoward incident occurs in connection with the said puja and the common people do not face any hindrance in visiting either the puja or the temple during the relevant period.

The Sub-Divisional Police Officer, Mandir Bazar, being the 5th respondent herein, is directed to keep strict vigil on the locality and ensure that there is no breach of law and order therein during the said period. The 5th respondent shall also ensure safe and free access of the dignitaries to the pandal in the police district for visiting the pandal during the said period.

With the aforesaid directions, the writ petition is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
