Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 6 months and during pendency of the present bail application, he was released on interim bail for performing the rituals relating to the death of his mother. Learned advocate for the State has produced the case diary.

I have considered the post-mortem report along with the statement of the witnesses.

Having considered the period of detention of the present petitioner, I am of the opinion that further detention of the

petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Special Court under the POCSO Act, Howrah. If on bail, the petitioner shall be physically present on each and every date of the trial and shall not leave the jurisdiction of Howrah Police Station without the leave of the learned Special Court.

Accordingly, CRM (M) 2160 of 2025 is allowed. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
