Learned advocate appearing for the petitioner submits that the petitioner was implicated for alleged recovery of 80 bottles of phensedyl and is in custody for about 10 months. Prosecution intends to examine 25 witnesses to prove its case, as such on any stringent conditions petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail.

Record of the case reflects that another accused namely, Jahangir Kabir @ Kanfora Jahangir has been granted bail in CRM (NDPS) 1084 of 2025 and petitioner is similarly situated as the said accused. Consequently, the prayer for bail of the petitioner is allowed.

As such, petitioner namely, Kabir Ali shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge, under NDPS Act, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Murshidabad without the prior permission of the learned Special Court.

Accordingly, the application for bail being CRM (NDPS) No. 1367 of 2025 is allowed.
