Mr. Chittapriya Ghosh, Ms. Komal Singh ....for the petitioner Mr. Ranjit Rajak ...for the State The petitioner claims that on July 21, 2018 the learned Civil Judge (Jr. Division), 6th Court, Alipore in T.S. No. 947 of 2018, ordered status quo in respect of the nature and character of the suit property. It is submitted that notwithstanding the order of status quo, the private respondents in collusion with the members of a local Panchayat, have tried to construct a road on the disputed property.

The Bishnupur Police Station, DDH Police District has submitted instructions dated December 17, 2019, indicating that proceedings under Sections 107/116 of the Cr. PC have been taken out.

This Court directs the Bishnupur Police Station, DDH Police District to strictly ensure that the order of status quo passed by the learned Civil Court is enforced without a demur. A detailed report as regards the property as on date shall be submitted

by the police to the Court below, within a period of 15 days from date.

The Bishnupur Police Station, DDH Police District shall also ensure that there is absolutely no breach of peace in the area.

With the aforesaid observations, the writ petition shall stand disposed of.

The instructions of the Bishnupur Police Station, DDH Police District, addressed to the learned State Advocate, dated December 17, 2019, be kept with the record.

There shall be no order as to costs.

Notice served on the private respondents, be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
