The petitioners are aggrieved that the respondent No.5, who had taken a loan of Rs.2 lakhs, has not yet refunded the same.

The respondent no.5, the borrower, is an employee of Eastern Railway and the respondent No.4 is his Drawing and Disbursing Officer (hereinafter referred to as the DDO). 4.

In view of the provision of Section 59(2) of the West Bengal Co-operative Societies Act, 2006 (hereinafter the referred to as the said Act), the respondent No.4 is directed to appropriate a monthly sum towards liquidation of the loan of the petitioners, the quantum whereof will be decided by the respondent No.4, depending on the salary being drawn by the respondent No.5.

With the aforestated direction, the writ petition is disposed of.

6. There shall be no order as to costs.

Since affidavits have not been called for, allegations contained in the petition are deemed to have been denied.
