Petitioner(s) Mr. Prabir Majumder Mr. Arup Kumar Bhowmick ... for the Petitioner(s) Mr. Bibaswan Bhattchryya Mr. Subhasish Datta ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for 16 months and till date only three witnesses have been examined out of the cited 18 witnesses.

Pursuant to the earlier direction, State has submitted a report which reflects that the cause of death is because of lacerated wound on posterior aspect of right lobe of liver. Let the report be kept with the record.

I have taken into account the statement of the witnesses and I find that there was assault by fists and blows.

Be that as it may, the petitioner is in custody for 16 months and there is hardly any possibility of the trial

concluding very soon, as such, on stringent condition, the petitioner may be enlarged on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Gadamal Murmu @ Godmal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned CJM, Malda.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Malda without prior permission of the learned trial court. Accordingly, CRM(M) 2176 of 2025 is allowed.

Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
