Mr. Goutam Dinda, Mr. Sandip Ray ... for the petitioner Mr. Suman Dey, Mr. Kaustav Chatterjee ... for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner was appointed as Craft Instructor by the Director of Mass Education Extension. By notification dated 21.12.2012 the Department directed that effect will be given to incremental benefit to the employees of Special School after completion of requisite training course. The petitioner underwent such training and thereafter prayed for incremental benefits. In fact by a letter dated 11.12.2018 the District Mass Education Extension Officer recommended his name for availing such benefit. In spite of this, the petitioner has not been granted such benefit. Learned counsel for the State respondent submits that in the event a decision is pending in

this regard, the same would be taken in accordance with law.

In view of the above, let the respondent No. 3 decides the issue of grant of incremental benefit to the petitioner in terms of the notification dated 21.12.2012 and in accordance with law as expeditiously as possible, preferably within six weeks from the date of communication of this order and upon taking into account representation of the petitioner in this regard, if any, and the recommendation made by the District Mass Education and Extension Officer.

With this observations, this writ petition being WPA 24149 of 2023 is disposed of.

It is clarified that as affidavits have not been called for, the allegations made shall be deemed not to have been accepted.

Urgent Photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
