Learned Advocate appearing for the State submits that there are five criminal cases pending as against the petitioner of involving the NDPS Act, 1985. Moreover, there are call details recording of conversation between the petitioner and the person arrested with the commercial quantity of narcotics. He refers to the contents of the charge-sheet in support of such contention. There are criminal antecedents of the petitioner. Chargesheet filed against the petitioner speaks of call details recording between the petitioner and the person arrested with the commercial quantity of narcotics.

In such circumstances, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

Consequently, we are unable to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner, is, thus, rejected.

CRM (A) 5216 of 2022 is dismissed.
