The report encloses a statement of the defactocomplainant, namely, Soumen Nandi, as well as a communication to the officer in charge of Goghat P.S. The case is under sections 420 and 406 of the IPC. None of the elements of public policy is involved over here and the defacto-complainant has categorically stated that he has no intention to proceed with the case as there has been an amicable settlement.

Having considered the nature of the case which was registered as Goghat P.S. Case No. 303 of 2023 dated 25.9.2023, I am of the view that as there has been an amicable settlement between the parties and the nature of the offence do not warrant further investigation or

continuation of the same before the ld. Jurisdictional court, the further proceedings arising out of Goghat P.S. Case No. 303 of 2023 dated 25.9.2023 corresponding to G.R. Case No. 1450 of 2023, is hereby quashed.

With the aforesaid observations, CRR 4004 of 2023 along with CRAN 1 of 2023 is allowed.

Pending application, if any, is also disposed of. Report so submitted be kept with the record.
