No. 29 KAUSHIK REJECTED C.R.M.(A) 5217 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Raiganj Police Station Case No. 1074 of 2022 dated 22.08.2022 under Sections 341/324/326/307/34 of the Indian Penal Code, 1860.

And In Re : Sanjay Das ...... petitioner Mr. Somnath Adhikary ....for the petitioner Ms. Sreyashee Biswas ....for the State Petitioner prays for anticipatory bail.

Learned advocate appearing for the petitioner submits that, there is counter case and that the petitioner also suffered injuries.

Learned advocate appearing for the State refers to the injury report, the statement of the injured and the other materials in the case diary.

Apparently, the petitioner assaulted the victim with a sharp cutting weapon and succeeded in inflicting deep wound on the neck and the hand of the victim. The injury report of the victim records that the victim requires surgery.

Considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 5217 of 2022 is dismissed.
