The petitioners seek police assistance to effect repairs in his house. Admittedly, a civil suit being T.S. 77 of 2021 is now pending before the learned Civil Judge (Jr.

Division), Berhampore, Murshidabad for partition between the petitioners and the private respondents.

The petitioners already applied in the Court below in the said suit for permission to effect repair. 3.

In the backdrop of the above facts, the instant writ petition is in gross abuse of process of law and is liable to be dismissed with costs assessed at Rs. 5,100/- payable by the petitioners to the Nowda Police Station, Murshidabad.
