It is submitted on behalf of the petitioner she is in custody for about 82 days. It is further submitted petitioner is a mere name lender Director and did not play any role in the affairs of the company. Investigation is complete. Principal accused i.e. son of the petitioner is in custody. Accordingly, she prays for bail.

Learned Advocate for the State opposes the prayer for bail and submits witnesses took the name of the petitioner as the Director of the company.

We have considered the materials on record. Petitioner is the mother of the Managing Director viz. Srisendu Maity who is in custody. She is an octogenarian. It is contended petitioner is a mere name lender Director. None of the documents seized in course of investigation bear her signature. In this backdrop, we are of the considered view petitioner's role in the day to day running of the company is marginal. suffered by the petitioner, we are of the opinion further detention of the accused/petitioner is not necessary.

Therefore, the accused/petitioner, namely Lila Maity @ Leela Maity, be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Hooghly at Chinsurah subject to condition that the said petitioner shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event she fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel her bail automatically without reference to this court. 6.
