The petitioners claim to be recorded owners of the plots in question by virtue of several registered deeds of conveyance executed in the years 2005 and 2009 respectively. The petitioners submit that a portion of the said property was acquired by the State-respondents for reconstruction of Aila affected areas in Sundarban in the year 2012 and compensation awarded for the same to the petitioners was found to be inadequate. The petitioners submitted several representations before the concerned authority for assessment of fair and adequate compensation in their favour which were not heeded to. The petitioners seek liberty to submit a comprehensive representation before the authority ventilating their grievance and pray for a direction upon the authority to consider the said representation at the earliest. It is submitted on behalf of the State-respondents that the 4th respondent be directed to consider the representation in accordance with law.

In view of the above, the writ petition is disposed of with liberty to the petitioners to submit a comprehensive representation before the 4th respondent ventilating their grievance within 7 days from date. The 4th respondent is directed to consider and dispose of the representation within two months from the date of receipt thereof after affording reasonable opportunity of hearing to all interested parties including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
