The West Bengal State Electricity Distribution Company Limited and others Ms. Prativa Ghatak, Mr. Milon Maity .... for the petitioner Mr. Jayanta Basu .... for the WBSEDCL Learned counsel for the petitioner reiterates her contention that despite having given a temporary connection to the petitioner for operating his submersible pump, the West Bengal State Electricity Distribution Company Limited (WBSEDCL) is dilly-dallying over giving a permanent connection. Although the WBSEDCL was directed to formulate and file a plan in writing today for giving permanent connection to the petitioner as applied for, to cut short the matter, learned counsel for the WBSEDCL submits, on instructions, that only three works are to be done by the petitioner for the purpose of giving permanent connection. It is contended that the petitioner has to:

(i) Install a meter room;

(ii) Put up the necessary wiring through a certified electrician;

(iii) Install the starters necessary.

Since the WBSEDCL has clarified its stand, the writ petition is not required to be kept unnecessarily pending, thereby drawing the litigation over a prolonged period.

Hence, WPA No. 24662 of 2022 is disposed of by directing the petitioner to comply with the three requirements as indicated by the WBSEDCL and recorded in this order at the earliest to enable the WBSEDCL to give such permanent connection to the petitioner.

As and when such work will be completed by the petitioner, the petitioner shall intimate such completion in writing to the WBSEDCL.

The WBSEDCL shall, within forty-eight hours from receiving such intimation from the petitioner, give the permanent connection to the petitioner upon compliance of all other due formalities by the petitioner.

There will be no order as to costs.

Urgent Photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
