Affidavit in reply on behalf of the petitioner filed in Court today is taken on record.

Upon hearing the submission made on behalf of the petitioner, the private respondents and the Bank, it appears that there are several factual issues which are required to be adjudicated to provide proper relief to the petitioner. The petitioner challenges a sale which took place in the year 2019.

The factual disputes cannot be adjudicated by the writ Court. As the sale already stood concluded by issuance of the sale certificate, the writ Court is not inclined to exercise jurisdiction in the matter. 4.

The instant writ petition is disposed of with the observation that it will be open for the petitioner to challenge the action of the Bank before the appropriate forum in accordance with law, if so advised.

The writ petition stands disposed of.
