The petitioner is an Anganwadi worker who prayed for transfer from present place of posting at Bamangola, District Malda to the District Dakshin Dinajpur. The petitioner since her marriage has to travel a distance of 50 to 60 km from her matrimonial home to her place of posting. Therefore, the petitioner prayed for such transfer. The representation of the petitioner is dated October 12, 2022.

It is submitted on behalf of the State authorities that there is no permanent Child Development Project Officer in Bamangola, District Malda. Only one Supervisor is working as opposed to 16 sanctioned posts. Furthermore, only 304 Anganwadi workers are working out of sanctioned posts of 331 Anganwadi workers. Therefore, the prayer for transfer has not been considered.

Having considered the rival submissions of the parties and the materials placed on record, this Court directs the Secretary, Women and Child Development

and Social Welfare or any other person authorized by him to dispose of the representation of the petitioner as per extant rules and policies within a period of eight weeks from date. The concerned respondent will consider whether an inter-district mutual transfer can be effected while passing a reasoned order.

Let such reasoned order be communicated to the petitioner immediately upon passing thereof. The respondents, if considered necessary, may give a personal hearing to the petitioner.

With the directions aforesaid, WPA 24671 of 2022 is disposed of.

The written instructions handed over in Court today is retained with the records.

Since no affidavits have been called in the present writ petition, all allegations contained therein are deemed not to have been admitted by the parties. All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.
