Mr. Deb Roy, learned advocate is appearing for the respondent State whereas Mr. Samanta is representing the writ petitioner. It is indicated that the writ petitioner desires for conversion of his contract carriage permit into a stage carriage permit.
As regards his prayer as above, the Court has earlier directed vide order dated 22nd August, 2022, in Writ Petition No. 18468 of 2022, that the respondent authority should consider and dispose of the petitioner's prayer for such conversion. The said order is yet to be complied with by the respondent no. 2.
Considering all as above, let this writ petition be disposed of, by directing the respondent no. 2 to immediately take up the prayer of the writ petitioner as above and decide upon the same.
For this the respondent no. 2 is directed to consider and decide upon the petitioner's representation dated 6th September, 2024, by dint of a reasoned order.
In doing so, the respondent no. 2 shall afford opportunity of hearing to the petitioner along with other person/persons who may have their interests to be affected due to such conversion.
The entire exercise as above shall be concluded by the concerned respondent no.2 within six weeks from the date of communication of the order and inform its decision to the petitioner, within a period of one week thereafter.
Since no affidavit-in-opposition has been called for in this case, all allegations made in this writ petition are deemed to have been denied by the concerned respondent.
The writ petition is disposed of.
