The petitioner is aggrieved by the proceeding by respondent no. 1/Bank against the petitioner under Section 13(4) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act (SARFAESI Act), 2002. The reason of the record reveals that the petitioner had approached this Court since DRT-II, Kolkata was not functioning. However, it has been informed that DRT-II, Kolkata is now functioning.

The present writ petition was listed for hearing on 13.05.2024, 15.05.2024 as well as today.

There is no appearance on behalf of the petitioners.

It seems that the petitioners were availed of their available remedy or are not interested in pursuing the present writ petition.

The present writ petition is accordingly dismissed in default.
