PP Mr. Imran Ali Ms. Debjani Sahu ...for the State This revisional application has been preferred for quashing of the charge sheet no. 145 of 2012 dated 27.5.2012 arising out of Chitpur Police Station Case no. 167 of 2011 dated 21.8.2011 under Sections 498A/406/34 of the Indian Penal Code. Learned advocate for the State submitted the case diary. It appears from the copy of the order sheet that the matter is pending for adducing evidence before the trial court after framing of charge. It is further allegation on behalf of the petitioner that the defacto-complainant being the charge-sheeted witness is not appearing before the court and for which the trial of the case is dragging for a long time and accordingly, he has prayed for direction upon the trial court for the disposal of the GR case no. 2267 of 2011 pending before the Judicial Magistrate, 1st Court, Sealdah at an early date.

Considering the facts and circumstances of the case, the revisional application being CRR 3553 of 2019 is disposed of with a direction upon the Judicial Magistrate, 1st Court, Sealdah to dispose of the aforesaid pending proceeding being GR case no.

2267 of 2011 within a period of four months from the date of the communication of this order and for that purpose, the court will be at liberty to take recourse as provided under Section 309 of the Code of Criminal Procedure, 1973.

Urgent photostat certified copy of this order, be applied for, be given to the parties upon compliance of all requisite formalities.
