The petitioner is aggrieved by the alleged illegal seizure of vehicle that was found to be carrying black stone granite without lawful permit. The vehicle also did not have valid documents. The driver of the vehicle was not produced despite repeated requests by the Investigating Officer. The vehicle is presently in the custody of the Mollarpur Police Station, Birbhum.

The petitioner may take steps in accordance with law for seeking release of his vehicle before the ACJM, Rampurhat, Birbhum.

The ACJM, Rampurhat, Birbhum shall be duly satisfied, after considering the report of the Investigating Officer and the de facto complainant and only then, if at all, shall permit release of the

vehicle, strictly following the provisions under Chapter XIII of the Cr. P.C.

The petitioner shall cooperate with the investigation.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
