Kausik (Allowed) CRM (M) 2181 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/Section 439 of the Code of Criminal Procedure, 1973 in connection with Jorasanko Police Station Case No. 94 of 2025 dated 30.04.2025 under sections 105/110/124/125/287/3(5)(7) of the BNS, 2023 read with sections 11C/11J/11L/26 of the West Bengal Fire Services Act, 1950.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 209 days and the petitioner happens to be one of the shareholder directors of one Rituraj Hotel wherein fire was set in and subsequently case has been registered by the police station.

Learned Public Prosecutor appearing for the State opposes the prayer for bail.

Having considered the offences complained of and the locus of the present petitioner, I am of the opinion that further detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Gaurav Kapoor shall be released on bail upon furnishing bond of Rs. 20,000/-, with two sureties of Rs. 10,000/- each, one of whom must be local, to the satisfaction of the learned ACJM -I Calcutta. If on bail, the petitioner, if he intends to visit abroad, he shall not leave the country without the permission of the learned court in seisin of the case.

The petitioner shall also be physically present on each and every date so fixed by the learned Trial Court. The application for bail, being CRM (M) 2181 of 2025 is, thus, disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
