The petitioner is a helpless lady who intends to take shelter at her matrimonial home.

I have considered the contents in the writ petition and I find that the Police authorities have no scope for interference. However, petitioner has a remedy under the relevant provisions of the PWDV Act, 2005. If such an application is filed the jurisdictional Magistrate will assess the facts of the case and would dispose of the application relating to residential rights preferably within three months from the date of filing of the application.

With the aforesaid observations, WPA 25253 of 2024 is disposed of.
