The private respondents are not represented despite service of notice.

Heard learned counsels for the parties.

The petitioners complain that the 7th private respondent who is a promoter has raised construction adjoining their land by encroaching upon a portion of their land. The private respondents are also trying to evict them from their property. The complaint lodged by the petitioners has not been acted upon by the police. Learned counsel for the State submits that pursuant to the complaint lodged by the petitioners, the police authority has held enquiry and prosecution has been submitted against both the petitioners as well as the private respondents. The police is keeping strict vigil over the area in order to avoid breach of peace.

Since the petitioners apprehend breach of peace and threat to their life and security, the police authority is directed to keep strict vigil over the area and ensure strict maintenance of peace and tranquility therein. With the above observations and directions the writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
