Learned advocate appearing for the petitioners emphasizes on the merits of the evidence which has subsequently surfaced in course of the trial. It has been submitted that the evidence at this stage hardly makes out a case against the petitioners and each of the witnesses who have deposed have restricted to the last seen theory. Learned advocate for the State has drawn the attention of the Court to the earlier order passed by the Coordinate Bench wherein by an order dated 28.10.2024 in CRM (DB) 3554/2024, it was directed that the trial should be completed within a period of eighteen months. Learned advocate submits that till date the said period is not over and the prosecution out of the cited 27 witnesses till date has been able to conclude evidence of 14 witnesses.

In view of the scheduled period so fixed by the earlier order not having been completed till date, I am of the opinion that the petitioner would better be advised to approach this Court after the said period is over.

Accordingly, CRM (M) 2189 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
