Petitioner submits he is innocent and his wife was severely assaulted by the complainant. A criminal case was registered. In retaliation, the present case has been instituted and he has been falsely implicated. He prays for anticipatory bail. 2.
Learned counsel appearing for the State opposes the anticipatory bail prayer. He submits petitioner and one Debasish Jash dishonestly induced the de facto complainant to pay substantial sums of money on the false promise of giving employment. Fake and forged letters issued by the petitioner and co-accused have been recovered in the course of investigation. Bank records show money paid by the complainant to Debasis Jash was transferred to the petitioner. 3.
We have considered the materials on record. Ample materials have been collected in the course of investigation which shows money was transferred by the complainant on various dates to Debasish Jash and therefrom to the petitioner. Fake documents alleged to be
produced by them have also been seized. It is possible out of sheer frustration the complainant had assaulted the wife of the petitioner. Given this state of affairs we are of the opinion custodial interrogation for progress of investigation is necessary and this is not a fit case to grant anticipatory bail to the petitioner.
