None appears for the private respondents despite service.
Learned counsel for the petitioner submits that despite an order of status quo granted by the learned trial Court in a suit filed by the petitioner against the private respondents, the private respondents are continuing to disturb his peaceful possession in the property in question and threatening to dispossess him therefrom in violation of the injunction order. An earlier writ petition was filed by the petitioner in this regard and by an order passed on July 23, 2006 a coordinate Bench of this Court directed the police authority to provide necessary assistance to the petitioner in order to maintain peace in the property. It appears from the report submitted by the State that pursuant to the complaint lodged by the petitioner,
enquiry was held and prosecution submitted under Section 126 of the BNSS.
The dispute between the parties is civil in nature. Since civil suit is pending, the petitioner is at liberty to take necessary steps before the learned trial Court for redressal of his grievance.
In the meantime, the police authority shall keep strict vigil in the area in order to avoid any untoward incident and ensure maintenance of peace and tranquility. The writ petition is disposed of.
There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
