Mr. Biswarup Mukherjee .....For the Petitioner Mr. Indrajeet Dasgupta ......For the Respondents The petitioner seeks directions for expeditious hearing of the application being Design No.364291-001 dated 17th May, 2022 pending before the Learned Controller of Patents & Designs, Designs Wing Kolkata. It is submitted on behalf of the petitioner that though the subject application was filed as far back as in 2022, the same has never been heard nor disposed of. In such circumstances, the petitioner prays for appropriate directions for expeditious hearing of the above application. The respondents remain unrepresented. In view of the non-appearance of the respondents, Mr. Dasgupta, Advocate, who usually appears on behalf of the statutory authorities, is directed to appear in this matter on their behalf.

It is submitted on behalf of the respondent authorities that, they have no objection if directions, as prayed for, are passed.

In view of the above, CO 3628 of 2024 stands disposed of by directing the respondent authorities to expeditiously adjudicate and dispose of the above application preferably within a period of three months from the date of communication of this order.

It is clarified that there has been no adjudication on the merits of the case and all issues are left open to be decided in accordance with law.

With the above directions, CR-IPD 2 of 2025 (Old No. CO 3628 of 2024) stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
