WPA 24207 of 2023 (Sanchita Biswas & Ors. vs. State of West Bengal & Ors.) Ms. Bidisha Chakraborty Mr. Poulam Dey .. For the Petitioners Mr. Suman Ghosh Ms. Munmun Tewary .. For the State Report submitted by the State is taken on record. It appears that out of 9 complaints lodged by the petitioners against the private respondents 8 complaints have culminated in charge sheets upon completion of investigation. The other complaint has ended in a final report. In view of earlier order of this Court the police has been keeping strict vigil over the area and ensuring maintenance of law and order.

The petitioners submit that the private respondents are continuously trying to take possession of the property belonging to the petitioners and are also trying to organise a fair and Durga Puja in the property. With regard to the alleged disturbance to the possession of the petitioners in the property in question the petitioners submit that a civil suit was filed by them and disposed of. However, the result of the civil suit is not before this Court.

The writ petition was filed in 2023 alleging attempt of celebration of Durga Puja in the land of the petitioners in the said year by the private respondents.

In view of efflux of time the writ petition has become infructuous.

In the event there is any disturbance to the peaceful possession of the petitioners in the property in question, they are at liberty to approach the appropriate forum for redressal of their grievance.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
