Learned advocate appearing for the petitioner submits that the petitioner was allegedly implicated in connection with the instant case wherein it was shown that 1000 bottles of phensedyl were recovered. The investigating agency subsequently submitted charge-sheet on 03.07.2025. The grievance of the petitioner is that the CDR, SDR and mobile tower location which the investigating agency claims to have been collected in course of investigation were not supplied to the present petitioner at the time of compliance of Section 230 of the BNSS.

Learned advocate appearing for the State submits that such documents and/or materials were supplied and there has been compliance of all legal formalities from the inception of the present case.

The infraction so pointed out by the petitioner do not make out any case for overcoming the rigors of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected.

However, the learned Trial Court would ensure in case any application is made in respect of strict compliance of Section 230 of BNSS.

The application for bail, being CRM (NDPS) 1370 of 2025, is, thus, disposed of.
