1. Report filed on behalf of the State is taken on record.

2. Despite service no one appears on behalf of the alleged survivor.

3. Learned counsel appearing for the petitioners submits that the petitioner nos. 1 and 2 are the parents of the principal accused being the petitioner no. 3 who was arrested and consequently the application for anticipatory bail was not pressed so far as he is concerned. There is no prima facie case is made out as against the present petitioner nos. 1 and 2.

4. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the materials available in the case diary including the statement of the victim.

5. Considering the above, the materials available in the case diary, the fact that the principal accused was arrested and the alleged roles ascribed to the present petitioners, I am inclined to grant anticipatory bail to the petitioner nos. 1 and 2.

6. In the event of arrest, the petitioner nos. 1 and 2 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner nos. 1 and 2 shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner no. 1 shall meet the I.O once a fortnight till submission of report in final form.

7. Accordingly, the application for anticipatory bail is allowed.

8. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
