This instant application is filed under Section 442 read with Section 528 of the BNSS, 2023; corresponding to Section 401 read with Section 482 of Code of Criminal Procedure, 1973, for quashing the proceeding being G.R. No. 2491 of 2024 arising out of Jagacha Police Station Case No. 82 of 2024 dated 18.5.2024.

Heard the learned Counsels for the parties. Perused the Case Diary. There are incriminating elements implicating the

present petitioner in the Case Diary. I have perused the statement of victim girl, medical report and seizure list. Prima facie it is not a fit case for quashing.

It is submitted that a charge has already been framed against the present petitioner. The Trial Court is expected to expedite the trial without being influenced by the observation made herein. It is further clarified that an observation made herein are tentative only.

Accordingly, the instant Criminal Revision being CRR 4363 of 2024 stands disposed of.

Case Diary may be returned to the learned Counsel for the State.

Urgent certified photocopy of this order, if applied for, shall be supplied to the parties upon compliance of all necessary formalities.
