The petitioner and the contemnor are represented by their respective counsel.

Mr. Srinath Singha Roy, learned Advocate appearing on behalf of the contemnors submits before this court that the contemnor Rajib Mondal came before this court but he had to leave the High Court since he was feeling sick.

At this stage, Mr. Patwari, Learned Advocate appearing on behalf of the writ petitioner filed a photocopy of the Provisional Mutation Order dated 02.03.2026 as issued by the Land Manager, Bidhannagar.

The photocopy of the provisional mutation order dated 2.3.2026 is taken on record.

On perusal of the said mutation order dated 2.3.2026 it reveals that pursuant to the direction passed by this court on 29.04.2025 in WPA 25106 of 2024 mutation has been effected in favour of Miss. Geetika Goyal for undivided 100% share of the property as mentioned in the schedule of the said order.

At this juncture, Mr. Patwari draws attention of this Court to the heading of the said order. It is submitted by Mr. Patwari that the contemnor for the reasons best known to him has given a caption "Provisional Mutation Order" in the said order dated 2.3.2026.

On careful perusal of the contents of the order dated 2.3.2026 it however, appears that pursuant to the order dated 29.04.2025 as mentioned supra, mutation has been effected in the name of Miss. Geetika Goyal. 8.

It thus appears to this Court that the order dated 29.04.2025 is substantially complied with.

With the aforementioned observation the instant contempt application is disposed of.

Though the contemnor is not present (may be on account of his health reason), this court finds no reason to keep the Rule pending and accordingly, the Rule as has been issued in the name of Rajib Mondal, is hereby recalled and the contemnor is hereby discharged. 11.

CPAN 1411 of 2025 is thus disposed of.
