The affidavit of service filed in Court is taken on record. 2.

This is an application for condonation of delay. There is a delay of 69 days in preferring the memorandum of appeal. The District Primary School Council, Howrah is represented. In spite of service, the State respondents are not represented even on the second call. In view thereof, we are inclined to take up the application for condonation of delay.

We are satisfied with the explanation offered for not being able to file the memorandum of appeal within the period of limitation. We condone the delay of 69 days in preferring the appeal.

CAN 1 of 2024 is accordingly, disposed of.

DPSC, Howrah is directed to file a report in the form of

an affidavit disclosing the steps taken between 30th March, 2003 till the date of appointment i.e. 19th August, 2004. The report shall also specifically state the date of publication of the result. The affidavit must disclose all the relevant documents in this regard. The affidavit shall be filed within two weeks from date.

Since the State is not represented, this order shall also be communicated to the learned Government Pleader for due compliance.
