18.11.2025 Serial no. 8 [G.S.D] CRM (NDPS) 1371 of 2025 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with NDPS Case No. 37 of 2025 arising out of Raninagar PS Case No. 111/25 dt. 23.02.2025 under sections 21(c)/29 of the NDPS Act.

APP Mr. Ashok Das ... for the State-respondent(s) Learned advocate for the petitioner submits that from the possession of the petitioner 35 bottles of phensedyl were recovered pursuant to the statement of a co-accused. Learned advocate also submits that the petitioner is in custody for more than eight months and, on any stringent condition, he may released on bail.

Learned advocate for the State opposes the prayer for bail and submits that initially 176 bottles of phensedyl were recovered from an accused and, subsequent to his statement, such recoveries were effected from a bush. Having regard to the period of detention of about 8 months and there being no possibility of the trial being concluded very soon, I am of the view that further detention of the petitioner is unwarranted in the facts and circumstances of the present case.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Safikul Islam @ Bulu @ Sofikul Islam shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court under NDPS Act, Berhampore, Murshidabad (Learned Addl. Dist.& Sessions Judge, 2nd Court).

If on bail, the petitioner shall not leave the jurisdiction of Murshidabad without informing the learned Special Court and shall for the next six months meet with the Inspector-in-charge of Raninagar Police Station once in a fortnight until and unless modified by the learned Special Court.

Accordingly, CRM(NDPS) 1371 of 2025 is allowed. Pending application(s), if any, is also disposed of. Report submitted be kept with the record.
