It has been submitted by the learned advocate for the petitioners that the respondents have been duly served. The petitioner has prayed for an order directing the respondent police authorities to provide protection to the petitioner so that the petitioner can enter into their own flat and reside there peacefully and perform homely Durga Puja. Learned advocate for the petitioner submits that yesterday i.e. on October 7, 2024, the petitioner could enter into his flat in the presence of his learned advocate. Learned advocate for the State submits that there is a longstanding dispute between the petitioner and the Apartment Owners' Association with regard to payment of

maintenance charges.

The dispute as to maintenance charges is not the subject matter of this writ petition. The Writ Court also cannot decide the dispute with regard to title and possession of an immovable property. However, it is the duty of the police authorities to maintain peace and tranquility at the locale.

Accordingly, the Inspector-in-Charge, Khardah Police Station is directed to keep a strict vigil and maintain peace and tranquility at the locale.

With the above observations, the writ petition stands disposed of.

There shall, however, be no order as to costs. (Hiranmay Bhattacharyya, J.)
