1. The revisional application has been preferred by the husband/petitioner praying for transfer of Misc. Case no.

18 of 2024 from the Court of learned Judge, Family Court, Asansol Sadar, Paschim Bardhaman to the Court of learned District Judge, Durgapur on the ground that he is unable to engage an Advocate at Asansol as his wife/opposite party is a practicing Advocate at Asansol.

2. On hearing the learned counsels for both parties and on perusal of the materials on record, it appears that the Misc. Case has been filed in the

Family Court, Asansol Sadar, Paschim Bardhaman by the wife/opposite party herein, for maintenance 24 years after their dissolution of marriage.

3. Both parties herein reside at Asansol, Paschim Bardhaman and suffer from ailments. The husband from cancer and wife from osteoarthritis.

4. Considering the said difficulty of the petitioner/husband to engage an Advocate at Family Court, Asansol Sadar, Paschim Bardhaman. It is directed that Misc. Case No. 18 of 2024 be withdrawn from the Court of learned Judge, Family Court, Asansol Sadar, Paschim Bardhaman and be transferred to the Court of learned Additional District Judge, Durgapur for convenience of both parties.

5. Learned Additional District Judge, Durgapur shall proceed with the suit in accordance with law with due notice upon both the parties.

6. Keeping in mind the case of the parties herein, the learned District Judge shall be at liberty to permit the parties to appear virtually, if the parties make such prayer.

7. CO 3619 of 2024 is disposed of.

8. Parties to act on the server copy of this order.

9. Let a copy of this order be sent to the concerned Courts for immediate compliance.
